Why is it that a habitual offender of drunk driving kills my 17 yrs old niece and seriously injures 2 of her friends and he walks away from the accident with 2 scratches? He has been charged with 2nd degree murder but I believe it should be !st degree since he knew the risks and had 3 previous offenses. What do you think?

Condolences Princess...and unfortunately it seems that most times the drunk driver walks away leaving families torn apart in the wake....

After the 2nd offense this fool shouldn't have gotten his license back...

Most of them go out again wthout the license...it should be first degree...but that implies motive and intent....they need a new catagory for this....

He didnt have a license and was still driivng. His father made a statement on TV that it would be easier if his son had just died instead.

in 06 my 2 best friends were in a wreck with a Drunk driver,and he killed one of my friends the other was injured pretty bad. both were only 18 we had just graduated hs not even a year before (she died right at midnight after mothers day) the driver didn't get charged with ANYTHING never set a foot in a jail cell,nada. and all because he had money.

almost a year later day before Valentines day,the same guy driving drunk once again wrecked and bout killed another girl..that girl..was ME..again he never got charged. i spent a month and 11 days in the hospital,mangled,and having multiple surgeries including restitching my bottom lip back to my face and he got to drive around with no worries. its BS

i'm sorry for your loss tho,it breaks my heart that she was so young =[

I agree with you on that. In a lot of states he would only be charged with vehicular manslaughter, with a max sentence of 5 years. It's not fair. In high school, I was president of my high school's chapter of SADD, and brought in some speakers that blew my mind with their stories.

Paula I am glad that you are here to tell your story. Its a miracle. My beautiful niece was an only child and had just graduated. She was suppose to start college this fall for forsenic science. I couldn't imagine losing 1 of my kids, especially my only child. Thanks so much guys for letting me vent.
